DUI in Maryland: 3 Things You Should Do When Pulled Over
It’s important to take note of every aspect of the event. This includes:
- Weather conditions
- Road conditions
- Traffic conditions
- Names of officers
- What you were wearing
- Sequence of events
- What sobriety tests were administered. (Remember that you are allowed to refuse to submit to testing.)
Why is it important to take note of all of these things? While many of these details may seem mundane, they may end up helping you greatly in your case.
For example, let’s say you agreed to submit to field sobriety testing. You performed the walk-and-turn test, and the officer said you failed the test. However, maybe the road was slippery because it had just rained. Police are required to complete these tests under a number of regulations, one of which is that conditions be ideal for testing. A slippery wet surface may not be ideal for testing, in which case the results of the test as it was performed could be invalidated, which could help your case.
Another example includes your own physical limitations. For example, if you have a bad leg, this can affect your ability to successfully complete the test.
Compare the conditions to “ideal” conditions.
So what are ideal conditions then? In general they are:
- A smooth surface
- Dry ground
- Low volume of traffic on the roadway
- In the middle of the day
Make sure you make a note of the conditions as they compare to these ideal conditions. As stated above, even if you submit to field sobriety testing, performance of the test under less than ideal conditions could potentially invalidate the results of the test.
